Note: This indenture gives Michael Kreider's son Christian, who lives on adjoining land, the right to dam and divert some water from the spring on Michael's property to his own property.
This Indenture made the twenty first day of December Anno Domini, 1811 Between Michael Kreider in the Township of Lebanon County of Dauphin and state of Pennsylvania yeoman of the one part. And Christian Kreider so the said Michael Kreider in the same place yeoman of the other part. Whereas the said Michael Kreider and Christian Kreider at the same time of the sealing and delivering of these presents are respectively seised in Fee and in two contiguous tracts pieces or parcels of land with the appurtenances in the Township and County aforesaid, and whereas there is a certain spring of water within the land of the said Michael Kreider and the said Michael Kreider allows his son the said Christian Kreider his heirs and assigns that he shall have the liberty and privilege to dam or raise the said spring three inches higher and to take or cause so much water from said spring that can run through a hole of the bigness or lareness of three quaters of an inch, and to dig and break up the ground for to make a trench from the said spring through the said Michael Kreider's land the distance about fifty yards to lead that said quantity of water through said trench and all along to his house for his use benefit and behoof of him the said Christian Kreider his heirs and assigns daily and ever hereafter for ever. Now this indenture witnesseth that the said Michael Kreider, for and in consideration of the sum of five dollars lawful money of Pennsylvania, to him the said Michael Kreider in hand well and paid by the said Christian Kreider at and before the ensealing and delivering of these presents. The receipt and payment whereof is hereby acknowledged Have granted bargained sold allowed permitted and confirmed and by these presents he the said Michael Kreider doth grant bargain sell allow permit [???] and confirm unto the said Christian Kreider his heirs and assigns the use liberties profit advantage and benefit for the cause all the water that can run through a hole that is three quaters of an inch large or wide from the aforesaid spring leading it through a trench from that spring to the said Christian Kreider's house in said trench daily and every day from time to time and all times hereafter for ever: For his use without the hindrance of him the said Michael Kreider his heirs and assigns or any other person of persons whatsoever and the said Michael Kreider his heirs and assigns shall not stop or cause to be stopped but shall allow the full quantity of water that can run through a hole that is three quarters of an inch large and running in said trench along as aforesaid daily and every day from time to time and at all times hereafter as aforesaid To have and to hold, the said use liberties and privileges hereby granted are meant mentioned or intended so to be granted unto the said Christian Kreider his heirs and assigns to the only proper use benefit and behoof of him the said Christian Kreider his heirs and assigns for ever. Note: Christian is granting to his son Daniel the same water rights granted to Christian by his father Michael Kreider
Know all men by these presents that I the within named Christian Kreider for in consideration of the sum of one dollar lawful money of Pennsylvania to him in hand well and truly paid by Daniel Kreider at and before the sealing and delivery of these presents the receipt and payment whereof is hereby acknowledged hath granted, bargained, sold, assigned released and confirmed by these presents doth grant bargain sell assign release and confirm unto the said Daniel Kreider his heirs and assigns all that the within water right or privilege for to take the water as within mentioned and described and within contained together with all and singular and also all the estate right title interest property possession claim [???] whatsoever concerning the within mentioned water right whatsoever of him the said Christian Kreider at law or equity or otherwise howsoever, of, in, to, or out of the within mentioned water right to have and to hold the said water right or water privileges unto the said Daniel Kreider his heirs and assigns to the only proper use benefit and befoof of him the said Daniel Kreider his heirs and assigns for ever. Be it remembered that on the third day of April A.
