Note: Joseph Kreider and his sister Lizzie are selling 109 acres of land to David K. Bomberger
This deed, made the fourteenth day of April in the year nineteen hundred and twenty seven (1927) between Lizzie Kreider, unmarried, and Joseph Kreider and Amy E. Kreider, his wife, all of the town and township of Annville, in the county of Lebanon and state of Pennsylvania, parties of the first part and hereinafter called the grantors, and David K. Bomberger, of the town, township, county and state aforesaid, party of the second part and hereinafter called the grantee. Witnesseth, that in consideration of thirteen thousand five hundred ($13500.00) dollars, in hand paid, the receipt whereof is hereby acknowledged, the said grantors do hereby grant and convey to the said grantee, his heirs and assigns forever.
All that certain messuage, tenement, farm and tract of land situated in the township of North Cornwall, formerly in Cornwall Township, in the county of Lebanon and state of Pennsylvania, bounded and described as follows, to wit: Beginning at a stone; thence by land formerly of Jacob Kreider, now of Mrs. Lorenzo Laudermilch, south eighty one and one half (81.5) degrees east eleven and four tenths (11.4) perches to a black oak thence by the same south three and one half (3.5) degrees east one hundred nine and one half (109.5) perches to a stone; thence by land formerly of Sauel Houck, now of Charles Spahr and Engle south eighty seven and one half (87.5) degrees west thirty two (32) perches to a stone; thence by land formerly of Henry Kreider, now of Daniel K. Bomberger, north one and one half (1.5) degrees east twenty six (26) perches to a stone; thence by the same south eighty eight and three fourths (88.75) degrees west sixty eight and one half (68.5) perches to a stone; thence by land formerly of Christopher Biegert, now of Ezra B. Kreider north fourteen and one fourth (14.25) degrees west one hundred seven and one half (107.5) perches to a stone; thence by land formerly of Henry Kreider, now of Daniel K. Bomberger, north fifty two and one half (52.5) degrees east eighty three and one half (83.5) perches to a stone; thence by the same north fifty two and one fourth (52.25) degrees east forty and one half (40.5) perches to a stone near an elm; thence by the same south seventy nine and one half (79.5) degrees east forty one and two tenths (41.2) perches to a stone; and thence by land of said Mrs. Lorenzo Laudermilch, south twenty and one half (20.5) degrees west ninety (90) perches to the place of beginning. Containing one hundred nine (109) acres and sixteen (16) perches, strict measure.
It being tract no. 1 of the same premises which Michael Kreider, J.S., and Nancy Kreider, his wife, by their deed dated March 6, 1868, and recorded in the office of the recorder of deeds in and for said county of Lebanon, in deed book D, vol. 3, page 208, did grant and convey unto their son, Josiah Kreider, his heirs and assigns forever. And the said Josiah Kreider, being so thereof seized, died intestate, on or about July 19, 1898, whereupon, on due application to the Orphans' Court in and for said county of Lebanon, an order was granted by the said court in proceedings in partition of the real estate of said decendent, and the above described premises, therein called purpart no. 4 were duly valued and appraised, and by the said county adjudged, decreed, allotted and confirmed on December 5, 1898, unto two of the children of said decendent, to wit, Jacob Kreider and Lizzie Kreider, the latter being one of the above named grantors, to have and to hold the same to the said Jacob Kreider and Lizzie Kreider, their heirs and assigns forever, as tenants in common, that is each of them to have one equal undivided half thereof, as in and by the records and proceedings in Orphans' Court docket no. 24, page 665, etc., relation being thereunto had, will more fully and at large appear.
And the said Jacob Kreider, being so seized in his demesne as of fee inter alia, of and in the undivided one half of the above described real estate, died testate on or about August 15, 1906, unmarried, without issue, having first made his last will and testament in writing, which was duly probated by the Register of Wills of Lebanon County and recorded in said registers' Office in Will Book I, page 636, wherein and whereby, amongst other things, he gave and devised his undivided one half of said above described real estate unto his brother, Joseph Kreider, one of the above named grantors, and his two sisters, Lizzie Kreider, also one of the above named grantors, and Annie Kreider, their heirs and assigns absolutely; and he further provided in said will as follows: "Subject nevertheless to this provision, that the said Joseph Kreider and the said Annie Kreider shall not sell their interest, which they may hereby acquire, in the farm which I own in common with my said sister Lizzie Kreider, and which is located in North Cornwall Township, county and state aforesaid, unless by the written consent of my said sister Lizzie Kreider."
And the said Annie Kreider, being so seized in her demesne as of fee, of and in the undivided one sixth of the above described real estate died on or about October 24, 1909, intestate, unmarried and without issue, leaving her surviving, as her only heirs-at-law, two brothers and two sisters, namely Ezra B. Kreider, Joseph Kreider, Mary Witmeyer, and Lizzie Kreider, the said Joseph Kreider and Lizzie Kreider being two of the above named grantors, to whom the said undivided one sixth of the above described real estate did descend and come under and by virtue of the intestate laws of the state of Pennsylvania.
And the said Ezra B. Kreider and Amanda K. Kreider, his wife, and Mary Witmeyer and Adam Witmeyer, her husband, by their deed dated April 5, 1911, and recorded in the office of the Recorder of Deed in and for the county of Lebanon in Deed Book M, vol. 4, page 386, did grant and convey all their respective undivided interests or shares in the within described premises unto Joseph Kreider and Lizzie Kreider, two of the above named grantors, their heirs and assigns forever. The said Lizzie Kreider, one of the grantors, above named, by joining in this deed gives her written consent to the sale of the interests in said farm which Joseph Kreider and Annie Kreider had acquired through the will of Jacob Kreider, deceased, as above set forth. And the said grantors do hereby warrant generally the property hereby conveyed, in witness whereof, said grantors have hereunto set their hands and seals the day and year first above written.
