Note: This deed describes four tracts of land in South Lebanon and North Cornwall Townships that Effie Bomberger Smith inherited from her parents, Daniel and Sallie Bomberger.
THIS INDENTURE, Made the Eighteenth day of October in the year of our Lord one thousand nine hundred and forty-seven (1947). BETWEEN Effie M. Bomberger Smith and Stanley L. Smith, her husband, of the Township of South Lebanon, County of Lebanon and State of Pennsylvania, parties of the first part, and Stanley L. Smith and Effie M. Smith, his wife, of the same place, parties of the second part:
WITNESSETH, That the said parties of the first part, for and in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration lawful money of the United States of America, well and truly paid by the said parties of the second part to the said parties of the first part, at and before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened enfeoffed, released, conveyed and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm unto the said parties of the second part, their heirs and assigns, as tenants by the entireties.
ALL THOSE FOUR CERTAIN farms and tracts of land situate in the townships of South Lebanon and North Cornwall, in the County of Lebanon, and State of Pennsylvania, bounded and described as follows, to wit:-
TRACT No. 1 - South Lebanon Township.
BEGINNING at a hickory, a corner of lands now or late of John Bomberger and I. R. Bucher; thence by land now or late of I. R. Bucher north eighty-six and one-fourth degrees east, thirty-one and six-tenths (31.6) perches to a white oak; thence by land of the same south four degrees east, forty-two and one-half perches to a stone in the middle of a public road leading from Lebanon to Newmanstown; thence along said road by lands now or late of Benjamin Swanger, south eighty-six degrees west, thirty-two (32) perches to a stone; thence by land now or late of John Bomberger, north three and one-half degrees west, forty-two and sixty-five hundredths (42.65) perches to the place of Beginning. Containing eight (8) acres and seventy-three (73) perches, strict measure.
Being the same premises which Susan B. Wenger and Frank Ebright, executors of the last will and testament of Henry Ebright, deceased, by their indenture dated April 3, 1908, and recorded in the Recorder's Office of Lebanon County, Pa. in Deed Book "E", Vol. 4, Page 758, granted and conveyed unto Daniel K. Bomberger, his heirs and assigns forever, reference being thereunto had will more fully and at large appear.
TRACT No. 2 - South Lebanon Township.
BEGINNING at a point in a public road; thence in the middle of a public road by lands now or late of Henry G. Wenger, north forty-four and three-fourths degrees east, thirty (30) perches to a point; thence in the middle of aforesaid road by lands of the same and lands now or late of Philip Glick south eighty-six and one-half degrees east, seventy-two and two-tenths (72.2) perches to a point in said road; thence in the middle of said road by lands now or late of the said Philip Glick south sixty-four and one-fourth degrees east, sixty-three and nine-tenths (63.9) perches to a point in aforementioned road; thence by tract now or late of __ Livering, south twenty-five degrees west, ninety-seven and twenty-eight hundredths (97.28) perches to a sandstone; thence by land now or late of Charles Smith and land now or late of Clara Lentz, respectively, south sixty-one and one-half degrees west fifty-one (51) perches to a point; thence by lands now or late of said Clara Lentz, south fifty-eight and one-half degrees west, twenty seven and eight-hundredths (27.08) perches to a point in a public road; thence in the middle of said public road by lands now or late of said Clara Lentz and land now or late of Daniel Miller, north sixteen and three-fourths degrees west, one hundred forty-two and eighty-eight (142.88) hundredths perches to the place of Beginning. Containing ninety-two (92) acres, and one hundred and fifteen (115) perches, neat measure.
Being the same premises which Lizzie M. Smith, widow, et. al., by their indenture dated November 18, 1933, and recorded in the Recorder's Office of Lebanon County, Pa. in Deed Book "X", Vol.6, Page 662, granted and conveyed unto Daniel K. Bomberger, his heirs and assigns forever, reference being thereunto had will more fully and at large appear.
TRACT No. 3 - North Cornwall Township.
BEGINNING at a stone at line of lands now or late of Herman Light and now or late of Josiah Kreider; thence along lands now or late of Josiah Kreider, north eighty-two degrees west, forty-one and three-tenths (41.3) perches to a point; thence along said land south fifty and one-half degrees west, forty and five-tenths (40.5) perches to a point at or near the Snitz Creek; thence along said land south fifty-one degrees west, sevety-eight and four-tenths (78.4) perches to a point; thence along lands now or late of Eliza Marshall, north twenty-nine and one-half degrees west, eighty-three (83.5) perches to a point in a public road; thence along said road north sixty degrees east, one hundred ninety-three and seven-tenths (193.7) perches to a point; thence along said road north fifty-nine and three-fourth degrees east, thirty-eight and two-tenths (38.2) perches to a point; thence along a lane and lands now or late of Henry Laudermilch, south four degrees east, thirty-five and one-tenth (35.1) perches to a point; thence by the same lane and lands now or late of Hiram Light, south eighteen and one-half degrees west, eighty-eight and six-tenths (88.6) perches to the place of Beginning. Containing ninety-six (96) acres and one hundred thirty-nine (139) perches, strict measure.
Being Tract No. 1 of the same premises Joseph Kreider, et. al., heirs at law of John S. Kreider, Sr., by their indenture dated April 4, 1927, and recorded in the Recorder's Office of Lebanon County, Pa. in Deed Book "L", Vol. 6, Page 679, granted and conveyed unto Daniel K. Bomberger, his heirs and assigns forever, reference being thereunto had will more fully and at large appear.
Tract No. 4 -North Cornwall Township.
BEGINNING at a stone, corner of other lands of Daniel K. Bomberger, and Mrs. Lorenzo Laudermilch; thence along lands of said Daniel K. Bomberger north eighty-two degrees west forty-one and three-tenths (41.3) perches to a stone; thence along same south fifty and one-half degrees west forty and five-tenths (40.5) perches to an iron pin along north side of Snitz Creek; thence along north side of said stream and lands now or late of David K. Bomberger, of which this was formerly a part, the following courses and distances: south forty-nine degrees east, fifteen and sixty-three hundredths (15.63) perches to an iron pin, south sixty-two and one-fourth degrees east thirteen and sixty-nine hundredths (13.69) perches to an iron pin and south seventy-one and one-half degrees east fourteen and twenty-four hundredths (14.24) perches to an iron pin along south side of said stream; thence along south side of said stream and lands of David K. Bomberger, north seventy-four and one-half degrees east, eight and forty-eight hundredths (8.48) perches to an iron pin and south eighty and one-half degrees east thirteen and three-hundredths (13.03) perches to an iron pin; thence along lands of Mrs. Lorenzo Laudermilch, north sixteen and one-fourth degrees east, forty-four and seventy-eight hundredths (44.78) perches to the place of Beginning. Containing fourteen (14) acres and fifty-two and twenty-six hundredths (52.26) perches.
Being the same premises which David K. Bomberger, single man, by his indenture dated May 25, 1937, and recorded in the Recorder's Office of Lebanon County, Pa. in Deed Book "F", Vol. 7, Page 70, granted and conveyed unto Daniel K. Bomberger, his heirs and assigns forever, reference being thereunto had will more fully and at large appear.
And the said Daniel K. Bomberger being so thereof seized in fee of the aforesaid four tracts of land, died on the wit, April 1, 1939, having first made his last will and testament, dated May 22, 1924, duly probated and remaining of record in the Office of the Register of Wills of Lebanon County, Pa. in Will Book "P", Page 669, wherein and whereby he gave and devised all his property, real and personal, including the above four tracts of land, unto his wife, Sallie Bomberger, for life, and upon her death or remarriage, to his daughter, Effie M. Bomberger, her heirs and assigns.
And the said Sallie Bomberger died on to wit, February 22, 1942, without remarrying, whereupon said premises became vested in the said Effie M. Bomberger, since intermarried with Stanley L. Smith, and being one of the parties of the first part hereto.
TOGETHER with all and singular, the buildings, improvements, woods, ways, rights, liberties, privileges, hereditaments and appurtenances, to the same belonging, or in anywise appertaining, and the reversion and reversions; remainder and remainders, rents, issues and profits thereof, and of every part and parcel thereof: AND ALSO, all the estate, right, title, interest, property, first part, of, in, and to the said premises, with the appurtenances:
TO HAVE AND TO HOLD the said premises, with all and singular the appurtenances, unto the said parties of the second part, their heirs and assigns, to the only proper use, benefit and behoof of the said parties of the second part, their heirs and assigns forever, as tenants by the entireties, and not as community property.
AND the said parties of the first part, for themselves, their heirs, executors and administrators, Do by these presents, covenant, grant and agree, to and with the said parties of the second part, their heirs and assigns forever, that they the said parties of the first part, their heirs, all and singular the hereditaments and premises herein above described and granted, or mentioned and intended so to be, with the appurtenances, unto the said parties of the second part, their heirs and assigns, against them the said parties of the first part, their heirs, and against all and every other person or persons, whomsoever lawfully claiming or to claim the same or any part thereof, Shall and Will Warrant and forever Defend.

We, the above named husband and wife, grantees in the above deed, hereby certify that the above deed to us is to be and estate by the entireties, and that the said property is not now or intended to be our community property; and further, that when either husband or wife spends expenditure is concurred in by both husband wife with the definite understanding and agreement that the community is not to have any interest in the real estate by reason thereof.
